Form 2290 Basics

Welcome back, Trucking Nation! Today we’re going to talk about something really exciting, the IRS Form 2290! Before you get too excited, let’s take a look at Form 2290 and who needs to file it. We know all these IRS numbers can be so confusing, and knowing exactly what to do and when is always a big challenge. We’re here to take away your confusion.

What is Form 2290?

Form 2290 is what you file your HVUT tax with. The HVUT applies to all vehicles weighing 55,000 pounds and over that drive on public roads and highways.

Who Has to File a 2290?

There are several exemptions, or suspensions, to the HVUT. That means these vehicles are not required to pay the HVUT. Suspended vehicles include those logging less than 5,000 miles for the year, agricultural vehicles that drive less than 7,500 miles for the year, vehicles that are considered non-highway vehicles, and vehicles used for the collection of blood. But any vehicle weighing more than the 55,000 pound threshold must file a 2290, whether it’s required to pay HVUT or not.

What Do I Have to Do?

So you’ve determined that you need to file a Form 2290. What do you do next? Well, you could download the Form 2290 from the IRS website yourself and fill it out manually. The instructions are only 12 pages long. Or you could file with ExpressTruckTax, and leave all the heavy lifting to us. When Do I Have to Do This?

Simply put, you must file your Form 2290 by the last day of the month following the month in which you first drove the qualifying vehicle. In subsequent years you’ll need to file by August 31st, since the tax year runs from July 1st to June 30th of the following year.

How Do I Prove to the DMV I Filed a 2290?

If you need proof that you’ve filed your Form 2290 in order to register your vehicle with your DMV, you’ll need a stamped Schedule 1 form. Again, you can go through the trouble of filing yourself, and waiting for the form in the mail, or you can e-file with us. Happy Monday, Trucking Nation! As you know, October is Breast Cancer Awareness Month. Last Monday, we here at ExpressTruckTax told you about United Materials, a concrete company in North Tonawanda, NY, that has painted one of its concrete trucks pink in order to raise awareness for breast cancer research. They also raised money towards helping survivors of breast cancer and finding a cure for the deadly illness.

The Power of The Trucking Nation

Proudly, United Materials is by no means the only member of the Trucking Nation to dedicate at least one truck to the fight against breast cancer. Leonard’s Express, a transportation provider in Farmington, NY, has adorned not one but three of its rigs with pinks ribbons, the universal symbol for breast cancer awareness. Leonard’s Express has also pledged to donate one penny for each mile these trucks drive, and all three trucks will average at least 100,000 plus miles each year.

Leonard’s Express has partnered with the Breast Cancer Coalition of Rochester to educate, advocate, and help those affected by breast cancer in Western and Central New York State. President of Leonard’s Express, Ken Johnson, explains his company’s decision to partner with the coalition: “Having witnessed the great work that the Breast Cancer Coalition of Rochester does it was an easy decision to support this fine organization, while at the same time raising awareness of the terrible disease that breast cancer is.”

The Heavy Vehicle Use Tax or HVUT is an annual fee assessed on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination. IRS Form 2290 is filed annually to pay the HVUT due on the taxable vehicle and proof of payment is the Stamped Schedule 1.

The damage to the road surface caused by heavy trucks is 160,000 times more than that of a car, according to the findings of the American Association of State Highways Official (AASHO) road test. The tax, which is based on the vehicle weight, is a significant source of transportation funding in the US. The HVUT ensures that operators of heavy trucks pay a little more for the highway network relative to the motorists than the light trucks who meet their responsibility through other forms of taxes (e.g., registration fees, motor fuel taxes) but do less damage to the system.  The monies collected are used to help pay for road repairs and maintenance.

Misconceptions about Filing Form 2290

Over the years, we have had reoccurring questions about a few misconceptions about filing Form 2290 for Heavy Vehicle Use tax (HVUT).  So we would like to provide some information to help clarify it for you.

What are my Payment Options?

There are 3 Options:
(1) Electronic Funds Withdrawal (EFW)
(2) Electronic Federal Tax Payment System (EFTPS)
(3) Mail a check or money order.

How do I apply for credit using Form 2290 when a vehicle is lost or stolen?

The Form 8849 Schedule 6, Claim for Refund of Excise Taxes, can be filed to claim a refund or credit of heavy vehicle use taxes previously paid.

What is a suspended vehicle?

A highway motor vehicle which does not exceed mileage 5,000 miles or less (7,500 miles or less for agricultural vehicles) is exempt from tax and considered ‘suspended.’

Do I pay the penalty using the Form 2290?

The IRS will notify you if you have a penalty due, at which time you can send a letter to the IRS explaining why you have reasonable cause for filing or paying late.

Heavy Highway Vehicle Use Tax Return Form 2290 (HVUT) Information

HVUT is the Heavy Vehicle Use Tax that is a fee assessed annually on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination.

You must file Form 2290 for the tax period beginning on July 1, 2012, and ending on June 30, 2013, if a taxable highway motor vehicle (defined below) is registered, or required to be registered, in your name under state, District of Columbia, Canadian, or Mexican law at the time of its first use during the period and the vehicle has a taxable gross weight of 55,000 pounds or more.

There are a few instances where a vehicle is exempt from paying the HVUT tax, even if most of those instances; a Form 2290 is required to be filed even if no tax is due. You can find detailed information on the IRS site at www.irs.gov/trucker.

You need: Business Details - Business Name (Sole proprietor can use their legal name) and address, EIN (Employer Identification Number), details of the authorized signatory.

Vehicle Details - Vehicle Identification Number (VIN) and Gross weight of the Vehicle.

Form of IRS payment-we suggest direct debit.

Heavy Vehicle Use Taxes must be filed using the Form 2290 on an annual basis. The Tax period for Heavy Vehicles begins on July 1st and ends on June 30th.The Annual renewal of your Form 2290 for a new tax period IS DUE BY August 31st each year.

For New Vehicles placed in service, the IRS Form 2290 must be filed by the last day of the month following the month of first use. For example, if you purchase and first use a vehicle in January, you must file a Form 2290 by the end of February.

You can still paper file, but the IRS requires anyone filing for 25 or more vehicles do so electronically and recommends that everyone do so.

Electronically: File Form 2290 electronically through any electronic return originator (ERO), transmitter, and/or intermediate service provider (ISP) participating in the IRS e-file program for excise taxes, such as ExpressTruckTax.com. Paper: Mail Form 2290 to the address showed under Where to File. If you did not pay the tax using the Electronic Funds Transfer or Electronic Federal Tax Payment System (EFTPS), mail Form 2290-V and your check or money order with Form 2290.

Form 2290 filing season started for Tax Year 2012-2013, E-file today with ExpressTruckTax

The Form 2290 Heavy Vehicle Use Tax (HVUT) filing season for the 2012-2013 tax year has begun!  The deadline for filing your return for all taxable vehicles used during the month of July is August 31, 2012. All tax must be paid in full by the deadline to avoid penalties.

This federal excise tax is imposed through the IRS Form 2290 on an annual basis. This IRS Form 2290 can be E-Filed in just minutes to complete this requirement. Once it is filed, the taxpayer will receive a Stamped Schedule 1. This is required by State DMVs in order to register heavy highway vehicles.
  

If you have not ever E-Filed a tax returns before, there is no need to worry. The E-Filing process is actually easier than paper filing. E-File a Form 2290 Online and Save Time on your HVUT filing

Each Year, Heavy Vehicle owners must file an IRS Form 2290 in order to fulfill the Heavy Vehicle Use Tax. This applies to all vehicles whose taxable gross weight is 55,000 pounds or more. This also only applies to vehicles operating on public roads for at least 5,000 miles during the tax year of July 1 - June 30. This mileage limit is different for agricultural [or farm] vehicles. Vehicles that are used for agriculture are allowed to travel up to 7,500 miles on public roads during the year and still remain exempt from the Heavy Vehicle Use Tax.

There are three different categories for HVUT rates for these vehicles. Vehicles below 55,000 pounds do not have HVUT because they do not qualify as a heavy vehicle. Vehicles between 55,000 and 75,000 pounds owe $100, plus $22 per 1,000 pounds over 55,000 pounds. Finally, for vehicles that are over 75,000 pounds the maximum HVUT is $550 per year.

Although it is rare, some Vehicles that fit the above description may be exempt from the HVUT and Filing requirements of Form 2290. To officially be exempt from filing Form 2290, the vehicle must be owned and operated by the following:

The District of Columbia
The Federal Government
State or local government
Mass Transportation Authority (Only if granted certain powers normally exercised by the state)
Non-Profit Volunteer Fire Department, Ambulance Association, or Rescue Squad
Indian Tribe Government (Only if the Vehicle is used for essential Tribe or Government Function)
American National Red Cross
Mobile Machinery that meets specifications for a chassis
Qualified Blood Collector Vehicles

As mentioned previously, a Form 2290 must be filed annually for each taxable vehicle that is used on public highways during the tax period. The Tax Period is from July 1st, and ends on June 30th. A Form 2290 must also be filed once a vehicle is placed in service. The due date for each month is the last day of the following month. For example: if a vehicle is placed in service on April 3, the Form 2290 will be due on May 31.

Due to this increase in web access, people are becoming more and more productive. As you may have noticed, the IRS is also moving in this direction. One particular example of this is IRS Form 2290, which is used to collect what is referred to as the Heavy Vehicle Use Tax or HVUT. It is a fee that the IRS requires all vehicles with registered gross weights equal to or exceeding 55,000 pounds to pay annually on heavy vehicles operating on public highways.

It is already mandatory for all Trucking Companies or other organizations that need to file a Form 2290 for 25 or more heavy vehicles to E-File the return instead of paper filing it. This IRS Form contains a Schedule 1 which must be stamped by the IRS before the vehicle can be registered with the state Department of Motor Vehicles. This form must be filed annually, for each taxable vehicle that is used on public highways during the current period. The Current Period begins on July 1st and ends on June 30th of the next year. For example: if a vehicle is placed in service on April 3rd, the Form 2290 will be due on May 31st.

The job of a Heavy Vehicle Owner Operator can be one of the most stressful and yet it is also one of the most vital for our nation’s economy. HVUT IRS Form 2290 Penalties

The law provides penalties for failing to file returns or pay taxes when due. There are also penalties for filing false or fraudulent returns. These penalties are in addition to interest charge on late payments. The penalty for filing a return late or paying the tax late will not be imposed if you can show reasonable cause for not filing (or paying) on time. If you file after the due date (including extensions), attach an explanation to the return to show reasonable cause.

Penalties for HVUT non-compliance are costly to motor carriers. The penalty for failing to file IRS Form 2290 by Due date is equal to 4.5 percent of total tax due, assessed on a monthly basis up to five months. Late filers not making an HVUT payment also face an additional monthly penalty equal to 0.5 percent of total tax due. Additional interest charges of 0.54 percent per month accrue as well.

Based on these rates, an HVUT liability that was originally $550 would climb to over $700 by the end of the five-month period of delinquency. In addition to these federal penalties, many states suspend the registrations of vehicles for which proof of HVUT payment has not been provided.

Penalties for HVUT non-compliance for states are even more costly. The Secretary of Transportation has the authority to withhold up to 25 percent of the state's Interstate Maintenance funds [23 U.S.C. 104(b)(5)] if it fails one of its periodic compliance reviews.

When an examiner detects non-compliance, any findings should be presented to management in the FHWA division office. Based on the assessment performed by FHWA division management, the matter may need to be brought to the attention of the U.S. DOT Office of Inspector General (OIG). If the OIG launches an investigation, the compliance review report will be delayed because information presented within it could be used as evidence during the criminal investigation.

Once all criminal investigations and prosecutions are complete, a finding of non-compliance may be made public. The procedures for dealing with a finding of non-compliance are detailed in 23 CFR 369.12-369.17. In the event that a state is found to be in non-compliance, the following procedures are followed:

• The Division Administrator notifies the Governor via certified mail of the finding of nonconformity
• The state is given 30 days to request a meeting to present evidence to overturn the nonconformity finding or to identify steps taken to bring the registration program into conformity
• The state has the option to present evidence in written form
• If the finding is changed to compliant, the Administrator issues a final decision and the matter is concluded
• A finding of nonconformity requires the authorization of the Secretary of Transportation and must be served on the Governor or his or her designee

Free IRS Form 2290 (HVUT) VIN Corrections

Correcting a VIN(Vehicle Identification Number) is very easy in our system. Typically the IRS processing time is the same as a standard 2290 form. In order to file a VIN correction, the taxpayer simply needs to file a IRS 2290 Amendment.

If they already have an account with us, they will need to click the orange 'Create New Return' button from the 'Dashboard' page inside their account. Once they click this button, they will be asked what form they would like to file. They will need to choose 2290 Amendment and then select the VIN correction option. The system will then walk them through the VIN correction filing process. The drivers can e-file a VIN correction through us even if the original 2290 was not filed through ExpressTruckTax.

There is no charge to e-file a VIN correction however they will need to enter a valid credit card in order to authenticate the filing. The card will not be charged.
