Things You Need To Know: HVUT, Highway Tax 2290, and IFTA Tax

Truck tax deadlines are approaching and truckers must stay on top of HVUT, Form 2290, and IFTA tax filing.
With every deadline comes more confusion.

You might think, “What are all these forms and payments, and why am I constantly dealing with them?”

Understanding HVUT, highway tax 2290, and IFTA tax will prepare you to file quickly each year and keep you from making filing mistakes.

Knowing the differences will also give you an idea of if you need to file, and when to file.

HVUT

HVUT, or Heavy Vehicle Use Tax, is a tax on heavy vehicles used to fund highway maintenance.

You must pay Heavy Highway Use Tax if your truck has a gross weight of 55,000 pounds or more and is driven on public highways over 5,000 miles per year. Gross weight is weight when fully equipped for service.

Heavy Highway Use Tax is an annual tax. The HVUT deadline is the same as the 2290 highway use tax form deadline. HVUT is also known as HVUT 2290 because of its connection with Form 2290, which we’ll talk about next.

Highway Tax 2290

Highway Tax 2290, or simply Form 2290, is the form used to pay your HVUT amount.

Form 2290 is also used to calculate the Heavy Highway Use Tax amount you owe, determine your truck’s category, claim an exemption or credit, and more.

Highway Tax 2290 proves why the HVUT 2290 amount you’re paying is what you’re paying.

You need an EIN to file 2290 Highway Use Tax Form. The deadline is the same as the HVUT 2290 deadline. File Highway Tax 2290 Form and pay HVUT 2290 by the end of the month after your first use month.

IFTA Tax

The IFTA tax is not related to HVUT 2290 and Highway Tax 2290 Form. IFTA, or International Fuel Tax Agreement, ensures that each state/province is paid the correct IFTA fuel tax.

IFTA fuel tax becomes important when vehicles travel frequently across state borders. If trucks fill up in one state and immediately cross to the next, the state they’re driving in is losing out.

With IFTA reporting, truckers track miles in each state.

You need to pay IFTA fuel tax quarterly if your vehicle has 2 axles and a gross vehicle weight or registered gross weight > 26,000 pounds, has a combined weight of 26,000 pounds or has 3 or more axles regardless of weight.

HVUT Form 2290 FAQs

1. What is my first use month?
Your first use month is the first month that you use your heavy vehicle during the tax period. The current HVUT period runs from July 1, 2018, to June 30, 2019. So if you were driving your current rig this time last year you are required to file by tomorrow’s HVUT deadline.

However, if you purchased a new rig during the previous tax year, you will need to base your due date on your first used month.

2. Can I pay the amount of HVUT I owe with a credit card?
Absolutely! Starting this truck tax season, the IRS is now allowing you to pay 2290 with credit card or debit! Or another option is to pay with direct debit or electronic funds withdrawal, by authorizing the IRS to debit the amount you owe from your bank account. To do this, you will need to provide your bank account and routing number, which can be found on one of your checks.

Or you can also pay with the Electronic Federal Tax Payment System, where you will create a free account at www.ettps.gov. The amount you owe will be debited from your bank account, but it could take up to 10 days to create your account.

If you want to, you can mail the amount you owe directly to the IRS with a check or money order. Just print your completed 2290-V (your payment voucher) from page 11 of your completed 2290 form and mail it with your payment.
3. What is an EIN?
Your EIN is your Employer Identification Number, and it’s used to identify a business entity. To complete Form 2290, you need an EIN and can apply for one online with the IRS. If you already have an EIN, it can be found on a previous stamped Schedule 1.

You cannot use your Social Security Number in place of your EIN on HVUT Form 2290. If you use your SSN instead of your EIN, your form will be rejected. If you need an EIN, you better hop to it because it takes about 14 days for your EIN to become active in the IRS’s system and your form could get rejected during that time.

4. How Do I file?

Your Trucking Guide To IRP Reporting

When it comes to truck taxes there are multiple forms to file and tons of deadlines. We know that you’re familiar with your Heavy Vehicle Use Tax Form 2290, and you regularly file your quarterly IFTA return, but what about your IRP return?

Your IRP return is actually pretty closely related to your HVUT return, and IFTA report, because you need your Schedule 1 to complete your IRP return, and you also need to track your mileage per jurisdiction. This may seem overwhelming, but we’re here to help clear everything up.

The Trucking Guide To IRP Reporting


First of all, IRP is the International Registration Plan and it’s a reciprocal agreement that authorizes proportional registration among the 48 contiguous United States and 10 Canadian provinces.

This agreement provides apportioned payments based off of the total distance operated in each jurisdiction (state). That means the operator of the vehicle must report the number of miles traveled per jurisdiction on an annual basis and pay the amount of taxes they owe to their base jurisdiction (home state).

IRP Requirements

You are responsible for completing your IRP return if you operate a heavy vehicle that operates in more than one jurisdiction and it:

  • Weighs more than 26,000 pounds
  • Has three or more axles, regardless of weight, or
  • Is a power unit and trailer with a gross vehicle weight higher than 26,000 pounds.
To first receive your IRP license you must register with your base jurisdiction. Then you will receive your IRP license, which should be carried in your cab at all times. You will also have a specially marked license plate.

Then each year you will need to file your IRP return to renew your tags and to continue legally operating in multiple jurisdictions. Your IRP return deadline is based on the expiration date on your license plate.

In order to complete your return, you need to list the mileage traveled per jurisdiction during the year. Your mileage can be recorded with the same online program you use for your IFTA report, like ExpressIFTA.

Don't Let Your HVUT 2290 Form Get Rejected

Whenever your Heavy Vehicle Use Tax is due you definitely want to get it in by the deadline to avoid penalties. However, part of making the deadline in time is correctly filing, so your form isn’t rejected.

If your Form 2290 is rejected it’s up to you to file corrections and resubmit it to the IRS by the deadline! If you wait too close to the deadline to file then you might not have time to correct it! Why Form 2290s Are Rejected


You Need An EIN To File

You are required to provide an EIN (Employer Identification Number) on your 2290 Form to complete it. An EIN is used to identify your business, so it’s different from your social security number (SSN), which is used to identify you as a person.

You can’t use your SSN in place of your EIN on your Form 2290 or it will instantly be rejected. If you do not have an EIN you can apply for one with the IRS online for free. Just keep in mind that when you apply you will instantly receive your EIN, but it takes at least 2 weeks to become updated in the IRS’s system and your form may get rejected during that time.

Your EIN Needs To Match

The IRS will be checking to see if your information on your Form 2290 matches what the IRS has on file. They will be taking an extra close look to make sure that your EIN matches your business name. If this information doesn’t match then your form could be rejected.

Before you file your Form 2290 you can call the IRS at 1-888-829-4933 to make sure your information matches what they have on file.

Duplicates Are Rejected

During each HVUT period, each VIN (Vehicle Identification Number) can only be filed for once. Make sure you carefully enter your VIN on your form so it’s error free. If it matches another VIN by mistake your form will be rejected. If you enter the incorrect VIN, don’t worry. You can quickly correct it for free with ExpressTruckTax.

Also, make sure that you aren’t filing for the previous tax period because that would make your form a duplicate. The current HVUT tax period runs from July 1, 2017, to June 30, 2018.

The IRS Needs Their Money

Unfortunately, when filing Form 2290 you have to pay the amount of HVUT you owe to the IRS. When e-filing you can pay the IRS through direct debit or electronic funds withdrawal. In order to do so, you must provide your bank account number and routing transfer number (RTN).

If you enter these numbers incorrectly, with even just one number off, the IRS will not be able to retrieve funds from your account and your Form 2290 will be rejected. This information can be found on one of your checks.

Your form will also be rejected if your account doesn’t have enough funds to cover the amount you owe. If your form is rejected due to having the wrong RTN you can edit your form. If you have insufficient funds in your account you can choose a different payment method.

Your Form 2290 Deadline


Alright, so the HVUT Form 2290 tax period runs from July 1 to June 30 of the following year. The current HVUT tax period began on July 1, 2017 and will end on June 30, 2018. This is important to know because the HUVT deadline is based on your vehicle's first use month.

Your first use month is the month that you first use your heavy vehicle on public highways during the tax period. Then your 2290 is due the last day of the month following the first use month.

Because most people first use their heavy vehicles in July at the beginning of the period their deadline is August 31st. However, if you don’t use your vehicle until October then your deadline will be on November 30.

What Is A Taxable Heavy Vehicle?


You have to file Form 2290 for all of your taxable heavy vehicles, which are highway motor vehicles with a taxable gross weight of 55,000 pounds or more. A highway motor vehicle is any vehicle that is self-propelled and designed to carry a load over public highways, regardless if they are also designed to perform other functions.

Examples of these vehicles include trucks, truck tractors, and buses. Usually, vans, pickup trucks, and panel trucks are not subject to the HVUT because they weight less than 55,000 pounds. 

What Are The HVUT Penalties?


If you fail to file Form 2290 by the deadline you will have penalties to face. The penalty for filing late is 4.5% of the total tax you owe and this amount will accrue on a monthly basis for up to five months.

Also, if you fail to make a payment by the deadline you will face an additional penalty of .5% of the total amount due. Plus, you will face an additional interest charge of .54% on a monthly basis as well.

Your HVUT Form 2290 Was Due Last Month

Happy fall! We hope you have been enjoying the cooler temperatures and maybe you’ve had the chance to catch a football game or two. Fall is a great time to relax before the holiday rush begins. You can really take a load off by knowing that you’re already handled you Heavy Vehicle Use Tax (HVUT) back in August around the 31st when From 2290 was due.

Unless...you missed the deadline?! That means your form is almost a month late. However, you don’t need to panic because the ExpressTruckTax team is here to help! We will answer your questions and explain exactly what you need to do.

My HVUT Is Late, What Do I Do? 


You are probably wondering if there are any penalties for filing late so we will get those out of the way first. The penalty for filing HVUT Form 2290 late is equal to 4.5% of the total tax due assessed on a monthly basis for up to five months. If you also make a late HVUT payment you will also face a monthly penalty of .5% of the total tax due and additional interest charges of .54% will accrue per month as well.

Those are some hefty fees, so it’s best to go ahead and file as soon as possible to avoid having them grow larger. However, if you can provide reasonable cause for filing late you may not face penalties. Simply attach your reasonable cause with your Form 2290 when you file and the IRS may accept or reject it.

The HVUT period started in July 2017 and will end in June 2018. The due date is based on your first used month for your heavy vehicles. You have until the last day of the month following the month you first use your heavy vehicle on public highways to file.

So, because most truckers first used their trucks in July at the beginning of the period, they have until August 31st to file, making it a major HVUT deadline day. However, if first use your truck later in the year, then you have a later deadline. For example, if you first use your truck in November then you have until December 31 to file.
