E-File the Form 2290 For any Heavy Vehicles First Used in April 2012

HVUT, or the Heavy Vehicle Use Tax Although the Heavy Vehicle Use Tax is imposed annually, it is also mandatory for vehicles to file for this using the IRS form 2290 after the first use month. The typical tax year for heavy vehicles begins on July 1 and ends on June 30. For vehicles that are first used during the tax year, a prorated tax must be paid for the months that the vehicle was in use. This can be done with the IRS Form 2290 and the easiest way to file the 2290 is through ExpressTruckTax.com

When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. For Example, vehicles that were placed in service during the month of March will need to file HVUT using the 2290 by April 30. The tax will be calculated based on the number of months the vehicle will have been used during the tax year. Remember that the tax year for Heavy Highway Vehicles is from July to June. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For Example, if a vehicle was used on March 28th, It will be taxed as though it was used the entire month.

Although it is rare, some Vehicles that fit the above description may be exempt from the HVUT and Filing requirements of Form 2290. To officially be exempt from filing Form 2290, the vehicle must be owned and operated by the following:
• The District of Columbia
• The Federal Government
• state or local government
• Mass Transportation Authority (Only if granted certain powers normally exercised by the state)
• Non-Profit Volunteer Fire Department, Ambulance Association, or Rescue Squad
• Indian Tribe Government (Only if the Vehicle is Used for essential Tribe or Government Function)
• American National Red Cross
• Mobile Machinery that meets specifications for a chassis
• Qualified Blood Collector Vehicles

E-File a Form 2290 Online and Save Time on your HVUT filing

Each Year, Heavy Vehicle owners must file an IRS Form 2290 in order to fulfill the Heavy Vehicle Use Tax. This applies to all vehicles whose taxable gross weight is 55,000 pounds or more. This also only applies to vehicles operating on public roads for at least 5,000 miles during the tax year of July 1 - June 30. This mileage limit is different for agricultural [or farm] vehicles. Vehicles that are used for agriculture are allowed to travel up to 7,500 miles on public roads during the year and still remain exempt from the Heavy Vehicle Use Tax.

There are three different categories for HVUT rates for these vehicles. Vehicles below 55,000 pounds do not have HVUT because they do not qualify as a heavy vehicle. Vehicles between 55,000 and 75,000 pounds owe $100, plus $22 per 1,000 pounds over 55,000 pounds. Finally, for vehicles that are over 75,000 pounds the maximum HVUT is $550 per year.

Although it is rare, some Vehicles that fit the above description may be exempt from the HVUT and Filing requirements of Form 2290. To officially be exempt from filing Form 2290, the vehicle must be owned and operated by the following:

The District of Columbia
The Federal Government
State or local government
Mass Transportation Authority (Only if granted certain powers normally exercised by the state)
Non-Profit Volunteer Fire Department, Ambulance Association, or Rescue Squad
Indian Tribe Government (Only if the Vehicle is used for essential Tribe or Government Function)

As mentioned previously, a Form 2290 must be filed annually for each taxable vehicle that is used on public highways during the tax period. The Tax Period is from July 1st, and ends on June 30th. A Form 2290 must also be filed once a vehicle is placed in service. The due date for each month is the last day of the following month. For example: if a vehicle is placed in service on April 3, the Form 2290 will be due on May 31.

IRS E-Filing System is Back Up (IRS Form 2290)

As some of you may have noticed, the IRS E-Filing System was down from late December until early January for anyone who needed to file the Form 2290 online. This was due to the yearly maintenance the IRS performs for its servers at the end of each year. If anyone submitted an IRS Form 2290 for Heavy Vehicle Use Taxes online during this time period through ExpressTruckTax.com the return was placed on hold until Monday, January 9, 2012. The returns have now gone through to the IRS and if anyone has new returns that need to be filed, they will not have to endure the wait that they would have had if they filed in late December.

Each person who files the IRS Form 2290 with the IRS through Express Truck Tax will receive Free Fax and Email Notifications to let them know when the Schedule 1 is ready. The taxpayer also has a variety of options if they would like to receive optional Text Message reminders as well. These Reminders can also notify your contracting or leasing company as well to let them know that a payment has been made. There is no additional cost to have the information sent directly to a contracting or leasing company.

The IRS payment can be made by 4 methods: Electronic Funds Withdrawal, EFTPS, Check, or Money Order. The IRS does not accept Credit Cards for the Heavy Vehicle Use Tax Payment. (The filing fees imposed by Express Truck Tax can be paid by Credit Card if you wish)

To pay by Electronic Funds Withdrawal, the IRS will need a bank account and routing number. For EFTPS, the taxpayer would need to have already setup an account within the Electronic Federal Tax Payment System. In order to pay by Check or Money Order, the form can still be filed instantly online, and a Payment Voucher can be printed and mailed to the IRS. The last page of the Form 2290 is a 2290-V (or payment voucher).

IFTA (International Fuel Tax Agreement) Information

Owners of qualified heavy highway motor vehicles that operate in at least 2 out of the 58 total jurisdictions must file IFTA on a quarterly basis. The abbreviation: “IFTA” is short for International Fuel Tax Agreement, which represents a tax collection agreement among the 48 contiguous United States and its 10 bordering Canadian Provinces.

Qualifying Highway Motor Vehicles
Any vehicle is considered to be a qualified motor vehicle if it is used, designed, or maintained for the purpose of transportation of persons or property and has a registered gross vehicle weight of more than 26,000 pounds. Also, any vehicle with 3 axles or more is considered to be a qualified motor vehicle regardless of weight. Finally, if the combined weight of all of its parts is greater than 26,000 pounds, it is also considered to be a qualified motor vehicle.

IFTA Process
Each state or province has a different rate and those rates can change each quarter. The state or province in which the vehicle is registered is considered to be its Base Jurisdiction. IFTA must be filed with the vehicle’s respective jurisdiction each quarter. Every driver must keep a trip log of how many miles are traveled in each state or province, as well as how much fuel was purchased in each state or province. This information can be kept on what are commonly referred to as trip sheets, or trip logs.

Reasons for IFTA
IFTA’s official purpose according to the International Fuel Tax Agreement, is “to promote and encourage the fullest and most efficient possible use of the highway system by making uniform the administration of motor fuels use taxation laws with respect to qualified member vehicles operated in multiple member jurisdictions.” When an IFTA form is filed with the appropriate jurisdiction, The Fuel Tax Report is then used to determine the tax amount due as well as the refund due. It is also used for redistributing collections from the jurisdictions that received IFTA payments, and the jurisdictions that deserved some. One of the reasons for the Fuel Tax is to ensure that a vehicle pays taxes to all deserving jurisdictions. For Example: if a vehicle travels through a state, but buys no gas while in that state, then there was no fuel tax paid to that state through the purchase of gasoline. Part of their tax would then be redistributed to the state that received no fuel tax through the purchase of gasoline.

Transportation Bill clears Senate committee

As of Thursday, September 8, 2011 the much talked about Transportation Bill known as SAFETEA-LU (Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users) was approved by a Senate committee.

This bill has had a significant amount of publicity ever since President Barack Obama made a speech from the White House Rose Garden last week, in which he was joined by Transportation Secretary, Ray LaHood, as well as Richard Trumka, president of the AFL-CIO, and also David Chavern, the chief operating officer of the Chamber of Commerce. He gave Congress another warning at that time also, stating that letting the transportation bill expire at the end of the month would be “not acceptable” and “inexcusable.”

The Senate Committee approved an extension of the current bill. This is the eighth time the bill has been extended. This will serve as a step in the right direction for the Transportation Industry, but as many have said, an extension is like a band aid on a bigger problem. There still needs to be new legislation put in place for this industry, it cannot simply be ignored.

However, the act of extending the bill seems to be all either party can agree to.  The Democratically-controlled Senate and the Republican-controlled House of Representatives have presented vastly different options for this bill.  The House proposed spending $235 billion over the next six years, while the senate proposed spending $109 billion over the next two years.

When asked to comment on the decision, Senator Frank Lautenberg of New Jersey stated: “The American people didn’t send us here to make unemployment worse and allow our roads to crumble—and that’s why we must act swiftly to extend this law," he continued. "Instead of putting up roadblocks to this extension, I hope our colleagues will work with us to fix the economy, help Americans get back to work and keeps our country moving forward. Once we have passed this short-term fix, we need to complete work on a long-term bill that strengthens investment in our national transportation network to create jobs, maintain our roads and bridges, and invest in rail and transit to ease commutes.”

This is a positive step for the Trucking and Transportation Industry. What You Need to File Internal Revenue Service Form 2290 Online(HVUT)

To file the IRS Form 2290 for Heavy Vehicle Use Tax, there are a few key pieces of information you will need to know in order to receive a stamped Schedule 1 from the IRS. First and foremost, you should have an idea as to the number of miles driven by each vehicle, because if a vehicle was driven less than 5,000 miles (or 7,500 miles if agricultural) then it would technically be considered to be a credit vehicle. Other information that is key to filing Form 2290 is your Employee Identification Number (EIN), Vehicle Identification Number (VIN), and the taxable gross weight of the vehicle.

The Employee Identification Number is a required section of the Form 2290. This is a number that is unique to you, and the IRS uses it to identify a business entity. If you do not have an EIN, you can apply for one through the IRS website.  

Another necessary part of the Form 2290 is, of course, the Vehicle Identification Number. Every vehicle is required to have a VIN, which is a 17 character combination of numbers and letters.  This information can typically be found on the registration or title of the vehicle. In order to know how much tax is to be paid, you must also report the Taxable Gross Weight of the vehicle. This can be found by adding the following totals: unloaded weight of the vehicle fully equipped for service, unloaded weight of any trailers equipped for service and customarily used in combination with the vehicle, and the weight of the maximum load customarily carried on the vehicle and on any trailers customarily used in combination with the vehicle.

Temporary regulations for Internal Revenue Service Form 2290

Waiting for the IRS to release the Form 2290 for HVUT for the new tax year will likely take quite a while. According to a Federal Register notice set to be published on Wednesday, July 20th, implementing new regulations states that taxpayers filing Form 2290 should not file before November 1, 2011. In addition to that, the IRS will not be releasing receipted Schedule 1 forms prior to Nov. 1st. The current HVUT system is currently up in the air. Without a law passed from Congress, the tax will expire by Sept. 30, 2011.

Under current regulations, a tax is in place for the period between July 1, 2011, through Sept. 30, 2011. If Congress remains inactive on the matter, taxpayers will merely be liable for that taxable period and would have to file by Nov. 30.

In the Federal Register, the IRS does state that if Congress extends the tax past Sept. 30, anyone who filed for the “short taxable period” would also be required to file a second Form 2290 for the rest of the 2011-2012 tax season.

Amid all of this confusion and what seems to be a chaotic situation for many in the Trucking Industry, you can take comfort that you will be able to Electronically file any HVUT taxes imposed by the IRS with our service. HVUT(U.S Federal Heavy Vehicle Use Tax Form 2290) Season Delayed by IRS

As you most likely know, the IRS has not yet disclosed the official Form 2290 for filing Truck Taxes.  This delay in the process has certainly caused some headaches for the service providers such as Express Truck Tax, who E-File this form on behalf of their clients.  Land Line, the business magazine for professional truckers, recently released an article about the delay.   In short, the Form 2290 will not be available until new legislation is passed, but drivers will be able to get their vehicle tags and register vehicles by using your previous year’s Schedule 1.

Before you make a mad dash to the IRS office to file your Form 2290 Heavy Vehicle Use Tax, hold on. A week before filing season for the IRS Form 2290 was due to begin on July 1, the Internal Revenue Service announced a delay.

New legislation needs to be passed before IRS can collect the HVUT for the entire year. And right now that tax legislation is tied up in Congress. This means that your normal filing, which was for the tax period beginning July 1, 2011, won’t happen.

IRS will not accept any paper format or e-filing at this time. In fact, the form has not been published by the IRS and is not even available yet. An announcement on when it will be in place is expected to be made by IRS.

While the IRS e-file is not available for the tax period beginning July 1, 2011, you can still e-file your 2290 tax return for the tax period July 1, 2010 through June 30, 2011.

The IRS may wait as long as possible so that a single tax return is all that will be necessary for the 2011-12 tax Year. However, a backup plan is in place so that a three-month tax (July, August and September) can be collected by the Aug. 31 filing deadline. When the new legislation is passed, it will determine what happens for the reminder of the 2011/12 tax year.

Can you get your tags and register your vehicle? The IRS says yes, you can get your tags for the tax period beginning July 1, 2011. Existing regs allow states to register a heavy highway vehicle when the application for registration is received during the months of July, August or September 2011. If you have your receipted Schedule 1 for the previous year’s taxable period – in this case July 1, 2010 through June 30, 2011 – states can accept it as proof of payment.

States must register newly acquired heavy highway use vehicles without proof of tax payment if you present the original or photocopy of a bill of sale showing that the truck was purchased by the owner during the 60 days before the date the state receives the application for registration.

Internal Revenue Service Form 2290 Section Overview

First Use Month
The First Use Month refers to the month that the vehicle was first used during the tax period.  If the vehicle will be used for the entire Tax Period, then July would be the appropriate month to select.  

Taxable Vehicles
On The Taxable Vehicles section, you can enter all of your taxable motor vehicles weighing 55,000 lbs or more.  Do Not Add vehicles that you expect to use less than 5,000 miles during the tax period (or 7,500 miles, If Agricultural Use).  These Vehicles are known as low mileage, tax suspended, or category W vehicles; and they can be added in another section.

Suspended Vehicles
Tax Suspended Vehicles, also known as low mileage or category W vehicles are not subject to taxation because these vehicles will remain below the mileage threshold of 5,000 miles during the tax period (or 7,500 miles, if Agricultural use).  

Prior Year Suspended Vehicles
If You Reported any vehicles as Tax Suspended or category W during the previous tax period, you must report these vehicles to the IRS if either of the following occurred:
A:  The Vehicle exceeded the mileage threshold
or
B: The vehicle was Sold
Do Not add a suspended vehicle if neither of these occurred

Sold, Destroyed, or Stolen Vehicles
If you Sold a taxable vehicle, or that vehicle was destroyed or stolen before June 1st, you are eligible for a pro-rated credit or refund.

Low Mileage Credits
If you paid Heavy Vehicle Use Taxes, but did not exceed the mileage threshold during a prior tax period, you are eligible for a credit or refund of the Heavy Vehicle Use Taxes paid during that period. Enter all applicable vehicles in this section.
