Filing HVUT with Form 2290 in 2011

As anyone in the Transportation Industry will already know, the filing process for Heavy Vehicle Use Taxes (HVUT) will be a little bit different than normal this year. The Schedule 1 of the Federal Heavy Vehicle Use Tax (HVUT), which is part of the IRS Form 2290, has been extended to November 30 of 2011. It is also not possible to receive a receipt for the Form 2290 until after November 1st. This means that the majority of those filing this tax will not do so until November.

Since a stamped Schedule 1 is required to register a vehicle with the Department of Motor Vehicles, they will be accepting the HVUT proof of payment for the previous tax year of July 1, 2010 – June 30, 2011, to make things go as smoothly as possible this year. The IRS has informed taxpayers of the Form 2290 delay and the available options for payment once the form is available.

The following items may be accepted by the DMV as proof of HVUT payment until November 30, 2011:
  • Original or copy of a Stamped Schedule 1 from the Form 2290 (electronically watermarked or manually stamped) for the previous tax year of July 1, 2010 – June 30, 2011.
  • A copy of the IRS Form 2290 from the previous tax year, filed with the IRS as well as a copy of the front and back of the check to the IRS for the entire HVUT payment.
  • Original or copy of an IRS Form 2290 (electronically watermarked or manually stamped), listing the vehicle as a “Credit Vehicle” for the previous tax year.

Once the IRS begins issuing the Form 2290 again, the process will revert to the normal procedures. The proof of HVUT payment will then be able to be sent to the DMV for any applications requiring HVUT verification.

This tax that the IRS collects is an annual tax on commercial motor vehicles that weigh
55,000 pounds or more. This is referred to as the taxable gross weight of a vehicle. Congress is in the process of extending the tax, and the previously mentioned due date exists as a temporary regulation that postpones the due date until November 30, 2011.

Obama Supports Transportation Bill to Save Jobs

President Barack Obama has once again urged Congress once more to extend the transportation bill, following a jobs report that was not very flattering of the American economy.  This message served as a warning that letting the current transportation bill expire would be an economic disaster that could be easily avoided.

Obama focused on the amount of jobs that would be furloughed and eventually removed if a decision could not be made in Congress. “Right away, over 4,000 workers would be furloughed without pay. If it’s delayed for just 10 days, we will lose nearly $1 billion in highway funding that we can never get back. And if we wait even longer, almost 1 million workers could be in danger of losing their jobs over the next year.” These jobs are literally left in the hands of Congress.  They can choose to extend the bill, or create a more long term solution, but action needs to be made regardless.

President Obama made a speech from the White House’s Rose Garden last week, in which he was joined by Transportation Secretary, Ray LaHood, as well as Richard Trumka, president of the AFL-CIO, and also David Chavern, the chief operating officer of the Chamber of Commerce. He gave Congress another warning at that time also, stating that letting the transportation bill expire at the end of the month would be “not acceptable” and “inexcusable.”

In his recent address, the president reiterated that thousands of workers and their families would be hurt if infrastructure projects like highway construction, bridge repair and mass transit systems were put on hold. Obama has previously spoken about renewing the transportation bill as a “no-brainer.” It is also important to note that Congress has renewed the bill seven times in the last two years, and as badly as Americans need jobs, not renewing it this time would be a grave mistake. Nonetheless, a new and sustainable bill would be the best option.

“But thanks to political posturing in Washington, they haven’t been able to extend it this time — and the clock is running out,” he said. Virginia, Minnesota and Florida are examples of states that have thousands of jobs on the chopping block, and the President argued that the decision to let the bill expire is “completely avoidable.”

“This isn’t a Democratic or a Republican issue — it’s an American issue,” he said. The president also mentioned that a group of 128 Democratic and Republican mayors have written to Congress, urging their representatives to pass the extension.

Obama also added a statement that nicely summarizes the heart of the issue: “There’s a lot of talk in Washington these days about creating jobs. But it doesn’t help when those same folks turn around and risk losing hundreds of thousands of jobs just because of political gamesmanship. We need to pass this transportation bill and put people to work rebuilding America.”

Federal Heavy Vehicle Use Tax Form 2290 Service Provider

If you are required to pay Heavy Vehicle Use Taxes (HVUT), you must file the IRS Form 2290. If you have been paying these taxes for many years, then you know that this form has historically been filed by paper. However, there have been some huge technology advances in the past few years and the IRS does now accept and encourage taxpayers to E-File their 2290 Form.

When selecting an Authorized E-File Provider, you should look on their website for something to verify that they are actually authorized by the IRS to E-File tax forms. You can also refer to the IRS Website to see a complete list of Authorized E-File Providers.  

If you are filing several types of Truck Taxes and not just the Form 2290, such as IFTA, or Form 8849 then it would be helpful to have them all filed from the same place. IRS Major E-File Milestone

This tax year has been a groundbreaking one for the IRS E-Filing system.  As you can see in this letter from the IRS Newswire, the Internal Revenue Service has now processed over One Billion tax returns through electronic filings.  The Electronic Filing system that began as a pilot project in 1986 has recently been heavily pushed by the IRS in recent years.  

This year in particular has been the most explosive.  Prior to the April 18th deadline of this tax year, the IRS had processed just over 100 million tax returns electronically.  This is an enormous growth rate for only one year!

When asked about the IRS E-File system, IRS Commissioner Doug Shulman said the following: “The one billion milestone means e-file has delivered real services to taxpayers, including faster refunds and more accurate tax returns. And because an e-file return costs us 20 times less to process than a paper return, this program means a more efficient government that has saved America’s taxpayers hundreds of millions of dollars.”

There are a variety of ways a person can E-File based on the type of return they are filing.  This year the IRS made it mandatory to E-File if a tax preparer is filing 100 or more tax returns.  Next year E-Filing will be mandatory for all tax preparers who file 11 or more returns.  The IRS set a goal of an eventual 80% of filers using E-File; this year the percentage was 79%.  

As mentioned earlier, there are different ways of filing different returns.  IRS Form 2290, for example, must be E-Filed by an IRS Authorized E-File provider.  The IRS does not provide an electronic option to file this through their website, but they do publish a list of authorized services.  Anyone who needs to file an IRS Form 2290 must use a recommended third party provider, such as Express Truck Tax, which also offers E-Filing for Form 8849, Free VIN Corrections, and online IFTA organizaton.  

The Hassle of Filing an IRS Form 2290

IRS Form 2290 is used to collect what is referred to as the Heavy Vehicle Use Tax or HVUT. It is a fee that the IRS requires all vehicles with registered gross weights equal to or exceeding 55,000 pounds to pay annually on heavy vehicles operating on public highways.

This IRS Form contains a Schedule 1 that must be stamped by the IRS before the vehicle can be registered.  This form can be mailed to the IRS, which can take up to several weeks to process.  It could also be taken directly to the IRS office, which can take several hours of your day.  This must be accompanied by a proof of EFTPS payment.  

This form must be filed annually, for each taxable vehicle that is used on public highways during the current period.  The Current Period begins on July 1st and ends on June 30th.  A Form 2290 must also be filed once a vehicle is placed in service.  The due date for each month is the last day of the following month.  For example: if a vehicle is placed in service on October 3rd, the Form 2290 will be due on November 30th.  

Even though there are thousands, if not millions, of Heavy Vehicles that are required to file HVUT the IRS still requires everyone to either mail the Form 2290 to the IRS or actually come to the IRS office.  Fortunately there is an easier way that has recently become available.

Getting Familiar With The Setup Process With Freight Brokers

Today I would like to point out some key things to look for in the setup process with freight brokers. This of course being when you will have to fill out an information packet and fax it back to a broker before they will allow you to haul their freight. I’m going to talk about the type of information you will receive from them and it’s relevance, the information and forms you will need to send back to them and the little things you should look for in the packet that if not followed correctly may cost you a bundle.

What type of info will a freight broker include about themselves?

With every freight broker setup packet you will receive many pages of information about that broker. These are not pages that you need to send back, but they are pages that you should save and staple together with the finished packet after you have faxed back what was required. This information at a minimum will include the following:

   1. All of the freight brokers contact information.
   2. Their freight brokers authority page (MC#)
   3. Their Insurance carrier information.
   4. The brokers surety bond.
   5. A reference page. (showing companies they have brokered freight to)

This is all information that you could find out just by knowing their MC#, but it’s just easier to have it on hand should they decide to stiff you on a payment and you need to make a claim against them.

What type of info will they require from me?

This is going to depend on the freight broker you are dealing with,some have very short packets (you will be thankful when you get that lucky!) and some will expect you to fill out an encyclopedia worth of what is sometimes pointless it would seem. following are the main things you will be asked to return every time guaranteed.

   1. A copy of your authority (MC#)
   2. Copy of your insurance.
   3. A current W-9.
   4. A carrier profile page.
   5. The contract with each page initialed and dated as well as properly signed.

For this reason it would be a great idea to have copies of the first 3 on your computer easily accessible if you are using an email fax server. After you have seen a few carrier profile pages it would also be a good idea to make one of your own as every now and then you will come across a broker who wants one, but fails to send you a form.

Things to look for in the setup process with freight brokers!

Some of this information will also be included in fine print on the load rate confirmation, which is the actual contract that a freight broker and trucking company enter into on a load by load basis. What you want to watch for is their policies that need to be followed that in many cases if not followed will garner a fine for your company. These may include the following stipulations:

   1. Fines for not being on time to a pickup or delivery.
   2. Fines for being reported as being uncooperative with their customers.
   3. Fines for damaged freight.
   4. Fines for not contacting them with load movement updates on their schedule.
   5. Payment information pertaining to what they will or won’t cover for things such as tolls, lumper fees,detention and layover.

Once you get the hang of the things to look for it’s best to just ask the broker any questions you may have about these things before you have them fax you a setup pack. Their will be some brokers who are too demanding and who are sticklers for all fines they say may be levied against you regardless of the circumstances. It’s a learning process every time you do business with a new broker, but if you pay attention to details you should have no problem at all.

Filing HVUT

IRS Schedule 1 Form 2290 is used to pay Heavy Highway Vehicle Use Tax (let’s call it HVUT for short). Those that need to pay HVUT can do so online through an IRS authorized e-filer. Online filing is mandatory when filing for 25 vehicles or more. Even if you don’t have a lot of vehicles, the IRS still recommends that file online. Make sure you use a secure and authorized online e-filer. The government uses the money received from the taxes to help maintain and improve roads/

Peak season for paying your HVUT starts in July. Taxes can be paid through June of the next year.

Here’s some of the information you’ll need when you file.
-Name and company information
-Vehicle Identification Numbers
-Number of vehicles
-Gross weight of the vehicles
